Former FBI Director James Comey returned to the headlines this week after a federal grand jury in Virginia re-filed two felony counts accusing him of threatening former President Donald Trump and transmitting those threats across state lines. Prosecutors say a 2025 social-media post showing an arrangement of seashells allegedly spelled out a coded call for violence, a claim Comey firmly rejects. After surrendering to U.S. Marshals in Washington, D.C., the 65-year-old was fingerprinted, released on a $100,000 bond and ordered to surrender his passport.
Comey has tapped veteran Raleigh defense attorney Meredith S. Morton, known for representing high-profile federal defendants, to lead his legal team. In a brief courthouse statement, Morton called the indictment “a political stunt masquerading as justice,” vowing a motion to dismiss on First-Amendment grounds.
Speaking later to CNN, Comey urged opponents of the former president to “stay focused on the facts and the law,” adding, “I will stand up in court and defend myself, but I will not be intimidated”. The remarks marked Comey’s first on-camera appearance since the Justice Department, now led by Trump-appointed Attorney General Mark Paxton, revived the case that a federal judge tossed last year because the original special prosecutor had been unlawfully appointed.
Legal analysts note that proving an actionable threat from an ambiguous photograph will be difficult, but the renewed prosecution keeps Comey—and his polarizing tenure at the FBI—at the center of America’s 2026 election conversation. Trump’s campaign has already fund-raised off the indictment, calling it proof that “no one is above the law,” while Democratic operatives argue it shows the former president’s willingness to weaponize the Justice Department against critics.
The court set an initial motions hearing for June 18. If convicted, Comey faces up to 10 years in federal prison, though sentencing guidelines make a lengthy term unlikely for a first-time offender. Regardless of the legal outcome, the case ensures that James Comey, whose 2016 decisions arguably reshaped a presidential race, will once again influence the nation’s political narrative just as voters head into the peak of the 2026 mid-term season.
